Terms & Conditions

Please note: These Terms govern use of this website and set out general terms for our services. They do not replace the separate written contract you will sign for any home-improvement work. If anything here conflicts with your signed work contract, the signed contract controls.

1. Acceptance

By using this website or by requesting, scheduling, or receiving services from us, you agree to these Terms & Conditions. If you do not agree, please do not use the website or engage our services.

2. Who We Are

This website and these services are provided by Property Services LLC, doing business as Charter Oak Maintenance Services (“Charter Oak,” “we,” “us,” or “our”), a Connecticut limited liability company serving Eastern Connecticut. Connecticut Home Improvement Contractor Registration No. HIC.0670768.

3. Use of This Website

The content on this website is provided for general information about our services and is offered “as is.” Text, images, logos, and design are owned by us or our licensors and may not be copied or reused without permission. You agree not to misuse the website or interfere with its operation.

4. Estimates & Quotes

Estimates and quotes are free and non-binding and are based on the conditions we can observe at the time they are given. Final pricing and scope are set in a written work agreement. If hidden or unforeseen conditions are discovered (for example, rot, water damage, or code issues), we will discuss any change in scope or price with you before proceeding.

5. Home-Improvement Work & Your Contract

For home-improvement work exceeding $200, Connecticut law requires a separate written contract signed by both parties. That contract includes the disclosures required by law, including your three-day right to cancel for sales solicited at your home. Where these Terms and your signed contract differ, the signed contract governs.

6. Scheduling & Site Access

You agree to provide safe and reasonable access to the work area and, where needed, water and power. Scheduling may be affected by weather, permitting, material availability, and factors outside our control. We will keep you informed of any changes.

7. Payment

A deposit may be required before work begins, with the balance due upon completion unless your contract states otherwise. Terms for late or returned payments are as stated in your signed contract.

8. Third-Party Providers & Subcontractors

We may, at our discretion, perform services directly or engage qualified subcontractors or third-party providers to perform some or all of the services (for example, lawn care and snow removal). In all cases, Charter Oak remains your contracting party and coordinates the work, and all providers are expected to meet our standards. We remain responsible for the services we arrange, subject to these Terms and your signed contract.

9. Workmanship (Labor) Warranty

We warrant our labor and workmanship against defects for thirty (30) days from the date the work is completed. If you notify us of a covered workmanship defect within that 30-day period, your sole and exclusive remedy is that we will re-perform or correct the defective workmanship at no additional labor charge.

This workmanship warranty:

  • is non-transferable and covers only the original customer for the specific work performed;
  • does not cover materials (see Section 10), normal wear, settling, fading, or weathering;
  • does not cover damage caused by misuse, neglect, alteration or repair by others, abnormal use, pests, or events outside our control (including storms and other acts of God); and
  • is void if the work is altered by others or if amounts due for the work remain unpaid.

10. Materials & Manufacturer Warranties

Materials we furnish carry only the applicable manufacturer’s warranty, if any. We pass those warranties through to you and make no separate or independent warranty on materials. Manufacturer warranties are governed entirely by the manufacturer’s own terms, registration requirements, and conditions.

Transferability of manufacturer warranties is limited and varies by manufacturer and product. Many are transferable only once, only within a set window after a sale of the property (often 60–90 days, and up to one year for some manufacturers), may require written notice, registration, and a fee, and may convert from “lifetime” coverage to prorated coverage upon transfer. You should review the specific manufacturer’s warranty documents for exact terms and deadlines. We are glad to provide product information on request.

11. Roof Rejuvenation Services

Our roof rejuvenation service is a preventative maintenance treatment intended to help extend the service life of aging asphalt shingles by restoring flexibility and water resistance. It is not roof repair or replacement and cannot fix broken, missing, curled, or otherwise deteriorated shingles. Any statements about added years of roof life or cost savings are general estimates based on typical results—they are not guarantees, and actual results vary with roof age and condition. The 30-day workmanship warranty in Section 9 applies to our application labor only; we make no warranty as to the treatment’s performance, longevity, or results.

12. Disclaimer of Other Warranties

Except for the express 30-day workmanship warranty in Section 9, and to the fullest extent permitted by law, our services and this website are provided “as is” and we disclaim all other warranties, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose. Nothing in these Terms waives any right that Connecticut law does not permit to be waived.

13. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or relating to any service or these Terms will not exceed the amount you paid us for the specific service giving rise to the claim. We will not be liable for indirect, incidental, special, or consequential damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Delays

We are not responsible for delays in starting or completing the work that are caused by circumstances outside our reasonable control. This includes delays caused by you (for example, not providing timely access, decisions, approvals, selections, or payment), by other contractors, suppliers, or trades, by inspections, permitting, or utilities, or by weather or other events beyond our control. Any start or completion dates we give are good-faith estimates, not guarantees, and we will not be liable for any loss, cost, or damage arising from such delays.

15. Customer-Directed Work

If you direct us to use particular materials, methods, or a scope of work that departs from our recommendations or from accepted trade practices — or if you decline recommended work — we will proceed at your instruction, but you accept the risk of doing so. We are not responsible for, and disclaim all liability for, any defect, damage, failure, or reduced performance that results from work performed at your direction against our recommendation or accepted practice, and the workmanship warranty in Section 9 does not apply to that work.

16. Right to Cancel

For any sale solicited at your residence, Connecticut law gives you the right to cancel the transaction within three (3) business days. The specific cancellation notice and procedure are provided with your signed contract.

17. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in New London County, Connecticut.

18. Changes to These Terms

We may update these Terms from time to time. The “Effective date” above indicates the current version. Your continued use of the website or our services after an update means you accept the revised Terms.
